1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the HibingeTV website (the "Service"), located at www.hibingetv.com and any subdomains operated by us. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time, and your continued use of the Service after any change constitutes your acceptance of the revised Terms.

2. Description of Service

HibingeTV is a free, ad-supported website that catalogs and links to films, including public domain classics, indie releases, and licensed titles. We do not host video files. Each film page embeds the official player provided by the host where the film is available, typically the Internet Archive, YouTube, or Vimeo. The Service includes film descriptions, cast and crew pages, genre browsing, search, and a personal watchlist stored locally in your browser. The Service is provided at no charge and does not require an account.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you should use the Service only with the involvement of a parent or guardian. By using the Service, you represent and warrant that you meet these requirements and that you are legally able to enter into a binding agreement.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service, its servers, or the systems of any third-party host we link to.
• Interfere with or disrupt the Service, including the advertising served on it, the embedded players, or the servers and networks that host them.
• Scrape, copy, or republish the written content of the Service, including film descriptions, cast and crew pages, and catalog structure, without our permission.
• Circumvent, disable, or otherwise interfere with the advertising, ad-serving technology, or cookies used by the Service.
• Use automated scripts, bots, or crawlers to access the Service in a way that sends more requests than a human reasonably could, except as permitted by search engine indexing.

5. Intellectual Property

The films linked from the Service include works in the public domain in the United States, indie films made available by their creators or rights holders, and licensed titles we have permission to embed. We do not claim copyright over the films themselves. However, the written content we produce, including film descriptions, cast and crew biographies, page layouts, the HibingeTV name and logo, and the overall arrangement of the catalog, is our original work and is protected by copyright. You may not reproduce, redistribute, or republish our written content without permission, except for brief quotation with attribution.

Some films may have been restored, rescored, colorized, or subtitled by third parties. Those additions may carry their own copyright separate from the underlying film. We make reasonable efforts to link to copies that are clearly public domain or properly licensed, but we cannot guarantee the copyright status of every element of every upload on a third-party host.

6. Third-Party Content and Services

The Service embeds video players operated by third parties, including the Internet Archive, YouTube, and Vimeo. When you watch a film, you are using the player provided by that third party, and your use is subject to their terms of service and privacy policy. We have no control over the content, availability, or practices of these third-party hosts. If a film becomes unavailable on its host, the embed on our page will stop working, and we may remove or update the listing.

7. Advertising

The Service is supported by advertising. We use Google AdSense, which serves ads on our pages. Google and its partners may use cookies and similar technologies to serve ads based on your prior visits to this and other websites. You can opt out of personalized advertising by visiting Google's Ads Settings page. We also use Google Analytics, Microsoft Clarity, and Meta Pixel to measure traffic and understand how the site is used. We are not responsible for the content of advertisements served on the Service. Clicking on an ad takes you to a third-party website that we do not control. We do not endorse and are not responsible for the products, services, or content advertised.

8. User Content

The Service does not currently allow users to post, upload, or share content. Your watchlist is stored locally in your browser and is never transmitted to us. If we add user-generated features in the future, we will update these Terms to cover them.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement. 10. Limitation of Liability

To the fullest extent permitted by law, HibingeTV and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the Service. This includes damages caused by the unavailability of a film on its host, the content of an advertisement, or the practices of a third-party video provider. Our total liability for any claim arising from the Service shall not exceed the amount you paid us, which is zero given that the Service is free.

11. Indemnification

You agree to indemnify and hold harmless HibingeTV and its operators from any claim, demand, or damage, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the Service.

12. Changes to the Service and Terms

We may modify, suspend, or discontinue the Service, or any part of it, at any time and without notice. We may also update these Terms. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any change means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which HibingeTV operates, without regard to conflict of law principles. You agree to submit to the jurisdiction of the courts located in that state for any dispute arising from these Terms or the Service.

14. Termination

We may terminate or restrict your access to the Service at any time, without notice or cause, including if we believe you have violated these Terms. Because the Service does not require an account, termination may take the form of blocking your IP address or disabling the Service for everyone. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimer, limitation of liability, and indemnification.
